01Agreeing to these terms
These Terms of Service (“Terms”) govern your use of the YardScale website, our application form, and any calls or communications with us (together, the “Site”). By using the Site, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Site.
If you use the Site on behalf of a business, you confirm that you are authorized to accept these Terms for that business.
02Our services and your agreement
The Site describes the marketing services YardScale offers to bathroom remodeling contractors, including on-site video production, ad creative, campaign management, and appointment generation.
Any services we actually provide are governed by a separate written service agreement between YardScale and your business. If anything on the Site conflicts with that agreement, the written agreement controls.
Descriptions on the Site — including what's included, such as video production — are summaries. The exact scope, fees, responsibilities, and any guarantee are set out only in your written agreement.
03Applications and availability
- Submitting an application or booking a call does not create a client relationship or obligate either party.
- We review every application and may decline any application for any reason, including market fit, business size, capacity, or metro availability.
- We generally work with one company per metro. Whether a metro is available is confirmed only when a written service agreement is signed; availability mentioned before then is not a reservation.
- You agree that the information you provide in your application and on calls is accurate and complete.
04Results and guarantees
Marketing results depend on many factors outside our control, including your market, pricing, capacity, seasonality, and how quickly your team follows up with homeowners. Results are not typical and are not a guarantee of your success.
Any appointment guarantee is governed solely by the terms of your written service agreement with YardScale, including how a qualified appointment is defined and what remedy applies if the number is not met. Nothing on the Site creates a guarantee on its own.
05Site content and imagery
Content on the Site is provided for general information about our services. Images, video, and interface examples on the Site are illustrative — some are AI-generated or created to represent the kind of work and footage we produce — and do not depict specific client projects, homeowners, appointments, or results unless we clearly say so.
06Intellectual property
The Site and its content — including text, graphics, logos, video, and design — are owned by YardScale or its licensors and are protected by intellectual property laws. You may view the Site for your own business evaluation. You may not copy, modify, distribute, or reuse its content without our written permission. Ownership of footage and creative produced for clients is addressed in the written service agreement.
07Acceptable use
When using the Site, you agree not to:
- submit false, misleading, or someone else’s information;
- interfere with or disrupt the Site, or attempt to gain unauthorized access to it;
- use bots, scrapers, or other automated means to access the Site or collect information from it; or
- use the Site for any unlawful purpose or in violation of these Terms.
08Communications
By submitting your contact details, you agree that YardScale may contact you by email, phone, and text message about your application and our services, as described in our Privacy Policy. For text messages, message and data rates may apply, message frequency varies, and you can reply STOP to opt out or HELP for help at any time.
09Third-party platforms
The Site may link to or rely on third-party services such as scheduling tools, video platforms, and advertising networks. We are not responsible for their content, policies, or availability. This site is not a part of the Facebook website or Meta Platforms, Inc., and is not endorsed by Meta in any way. FACEBOOK, INSTAGRAM, and META are trademarks of Meta Platforms, Inc.
10Disclaimers
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, YardScale disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
11Limitation of liability
To the fullest extent permitted by law, YardScale and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US$100). This section does not limit liability under a signed service agreement, which is governed by that agreement’s own terms.
12Indemnification
You agree to indemnify and hold YardScale harmless from any claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or your violation of these Terms.
13Governing law and disputes
These Terms are governed by the laws of the United States and of the state in which YardScale has its principal place of business, without regard to conflict-of-law rules. Any dispute relating to the Site will be resolved in the state or federal courts located there, and you consent to their jurisdiction. Disputes relating to a signed service agreement are governed by that agreement.
14Changes to these terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date above. Your continued use of the Site after an update means you accept the updated Terms. If any part of these Terms is found unenforceable, the rest remains in effect.
